Ceng Guangxiu of Xichang Sent to Reform Through Labor for One Year for Her Rights Protection Work in Opposing the Demolition of Some Houses

[Tianwang Sichuan 1 March 2012] China Tiangwang Human Rights Affairs Center news: The Xichang City Committee issued a document calling on the people involved to resign and Ceng Guangxiu was sent to reform through labor for her rights protection work in opposing the pulling down of some houses.

This afternoon, Ceng Guangxiu's mother, Ceng Jizhen came to the Tianwang offices to report that she had failed completely in her efforts to appeal the sending away of her daughter for one year for her rights protection efforts in opposing the demolition of some houses.

According to reports, Ceng Guangxiu is a villager from Xichang's Xijiaoxiang in a rural part of Xichang. In 1995, she passed the entrance examination for Panzhihua University and later worked in a development company in Xichang. After 2006, because the Xichang City People's Government requisitioned his ancestral land, she began petitioning to higher levels of government to protect her rights.

In March 2006, the Xichang City Committee issued a document demanding the Ceng Guangxiu resign his employed in the urban part of Xichang City or else she would not be included in the project of tearing down houses and resettling people elsewhere. Ceng Guangxiu, after quitting her job at the demand of the Xichang City Committee, and so Xijiaoxiang did make arrangements for the resettling of her family.

On May 6, 2009, at about 10:30 AM, Ceng Guangxiu, just after leaving the courtyard of Beijing's Chaoyang District detention center was set upon and beaten by several public security officers from Liangshan Prefecture. Then she was forced into a police car and then taken in custody back to the Tuohuang Detention Center in Xichang.

Three days later, the Xichang Public Security Bureau took her into criminal custody on "suspicion of assembling a crowd for the purpose of disrupting public order". Later, because the Xichang Procuratorate did not approve a formal arrest, she was released on June 12th of the same year. On September 22, 2009, the Xichang City Public Security Bureau in order to "maintain stability", because the grassroots organization discovered that she was "preparing to do improper petitioning in Beijing during the national day celebration period", they were able to stop her in time and so Ceng Guangxiu was criminally detained on charges such as "suspicion of assembling a crowd for the purpose of disrupting public order".

On October 21, 2009, the Xichang City Public Security Bureau revoked this case because of insufficient evidence and released Ceng Guangxiu. But just one day later, the PSB decided to sent her to reform through labor for one year. She was sent in custody to the Sichuan Women's Reform Through Labor Center in Zizhong County, Neijiang City. Only after the justice organs had already sent Ceng Guangxiu in custody to the Zizhong County Reform Through Labor Center were the relevant documents sent to Ceng Jizhen.

Ceng Guangxiu after her reform through labor term concluded, has on many occasions appealed to various levels of people's government and to the leading departments in charge of reform through labor in order to win satisfaction for her legitimate, legal demands. There was no official response to any of her appeals. This afternoon, Ceng Guangxiu's mother, Ceng Jizhen once again presented the file to the Sichuan Province People's government but has not received any positive response.

The China Tiangwang Human Rights Affairs Center will continue to follow developments in this case.
